Options for compensation

The first thing you should know about car accidents in Pace, Florida is that Florida is a "No-fault State". This means that in the event of a car accident, both parties involved in the accident must get compensation from their own insurance company – no matter who is at fault. Thus, even if the other driver was careless and indisputably caused the accident, you cannot sue him for compensation.

Personal Injury Protection insurance is compulsory for all drivers.

To this end, as a resident of Florida, you are required to have Personal Injury Protection insurance in addition to your car insurance policy. This makes it easier for you to seek medical treatment if you were injured in the car accident.

Who does my Personal Injury Protection insurance policy cover?

However, you should know that there is a limit to how much claim you can make for medical expenses on your personal injury protection insurance. If your injuries require medical expenses that exceed what your PIP insurance can cover, you can sue the other driver. Another instance in which you can sue the other driver is if your injuries exceed the “injury threshold” of Florida.

The minimum value of personal injury protection a person can carry in Florida is $10,000 in PIP and $10,000 in property damage liability. It covers a child, members of your household and passengers in the car who did not have PIP insurance. If you had a passenger in the car that carried PIP coverage, that person will go to his or her own insurance company to get compensation for injuries. The PIP also covers your child if he or she suffers an injury while riding on a school bus. Other situations in which your PIP covers you include:

  • It covers you while you are riding in someone else’s vehicle
  • It covers you if you suffered an act of violence while driving e.g. carjacking
  • It covers you as a pedestrian or as a bicyclist if you suffer an injury involving a motor vehicle

It covers 60% of your lost income and/or learning capacity as a result of the accident. The maximum amount PIP coverage pays is $10,000 unless your policy affords you a higher amount. If your expenses exceed this amount, you will have to recover the remainder from the driver who was at fault in the accident.

Vehicles that are exempted from the mandatory Personal Injury Protection coverage include school buses (as injured children are covered by their parents’ policy), limousines, taxicabs, motorcycles and other vehicles with less than four wheels and vehicles that are not self-propelled (mobile homes or inoperable vehicles).

What does my Personal Injury Protection insurance policy cover?

Your PIP insurance pays for 80% of your reasonable medical bills. This includes the cost of:

  • Medical, surgical, X-ray, dental or rehabilitative services
  • Prosthetic devices
  • Wheelchairs
  • Crutches
  • Slings and Neck braces
  • Splints
